Things Get Out of Hand in L.A. Divorce Trial

A husband has succeeded in winning an appeal because the judge did not properly divide the community property assets and debts. But the real story in this case may have been the behavior of the husband’s attorney. The judge referred to it as unprofessional and it’s easy to see why.

To begin with, counsel used profanity during the case and blurted out that the Court ruled against him because he was Mexican. One time, when the other side objected, the lawyer said “Your Honor, you need to sanction this woman. If she was a child, I would get my belt and just whip her”.

To top things off, the court clerk observed him “give the finger” to the wife.

The same attorney represented the husband on appeal. The case was not certified for publication, which means it cannot be cited as precedent by judges and lawyers in California. But if you want to check it out, it’s In re Marriage of Martinez. The trial court case number is SD030729, and the number from the Court of Appeal was B279066. Go to footnote no. 1 and you’ll see I’m not making this up.

To be fair, though, the trial judge said it wasn’t just the husband’s lawyer who was difficult; both lawyers were.

The trial lasted about three days.
